Welcome to LearnNDev!

LearnNDev (operated by Aaras Learning Private Limited) complies with applicable global and local laws, including India’s Digital Personal Data Protection Act 2023 (DPDP Act), the Information Technology Act 2000, GDPR, UK GDPR, CCPA/CPRA, COPPA (where applicable), and other international regulations, to the extent they apply to our Services and your location. These Terms of Use (“Terms”) form a legally binding agreement between you and LearnNDev and govern your access to and use of LearnNDev’s platforms, services, websites, mobile apps, learning management systems, and AI-powered tools (collectively, the “Services”). By using our Services, you agree to these Terms, our Privacy Policy, and any applicable local laws. If you do not agree, you must stop using LearnNDev. If there is any conflict between these Terms and mandatory rights granted to you by the laws of your jurisdiction (for example, consumer or data protection laws), your mandatory local rights will prevail in that jurisdiction.

Scope of Services

    LearnNDev provides online learning, digital content distribution, collaboration tools, and AI-driven educational technologies. These Terms apply to:

  1. Our websites and mobile applications
  2. Learning portals, learning management systems, and API
  3. AI assistants, chatbots, and analytics tools
  4. We may add, modify, or discontinue features. Reasonable notice will be provided for material changes where feasible, unless immediate action is required for legal, safety, security, or operational reasons. LearnNDev may experience downtime, maintenance, or updates. LearnNDev is not responsible for interruptions beyond reasonable control, including force majeure events (such as natural disasters, war, government actions, or network outages)

User Accounts and Responsibilities

To use certain parts of the Services, you may need to create an account. You agree to:

  • Provide accurate, current, and complete information when creating and maintaining your account.
  • Keep your login credentials confidential and not share them with others
  • Notify LearnNDev promptly if you suspect unauthorized access or use of your account.
  • Age and Eligibility

    You may use the Services only if you are at least the minimum age required by law in your jurisdiction (e.g., 13 under COPPA/US law, 13-16 under GDPR-K/EU law). If you are under 18 (or the age of majority in your jurisdiction), you may use the Services only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

    LearnNDev does not knowingly collect personal data from children under 13 (or under the minimum age in your jurisdiction where a higher age is required by law, such as for COPPA or similar regulations). If LearnNDev becomes aware that personal data has been collected from a child in violation of applicable law, such data will be deleted promptly. Parents or guardians may contact LearnNDev to review or request deletion of their child’s data

    Educational Purpose

    Courses, content, and certifications provided by LearnNDev are for educational and informational purposes only. They do not guarantee employment, academic credits, professional licensing, or admission, unless expressly stated in writing by LearnNDev or a partner institution.

    You are responsible for all activities that occur under your account unless you have notified LearnNDev of suspected misuse or unauthorized access

    If you access LearnNDev Services on behalf of an organization (such as an employer, university, or institution), you represent and warrant that you have the authority to bind that organization to these Terms. In such cases, “you” refers to both the individual user and the organization.

    You agree not to cheat, plagiarize, falsify completion, misuse certifications, or engage in any form of academic dishonesty. LearnNDev may revoke certificates or credentials issued in violation of this clause.

    Payments and Subscriptions

    If any Services are offered on a paid or subscription basis, you agree that:

  • You will provide valid, complete, and up-to-date payment information
  • Fees are due in the currency and at the price stated at the time of purchase. All fees exclude applicable taxes (e.g., GST in India).
  • Unless otherwise specified, fees are non-refundable except where required by applicable law or expressly stated in writing by LearnNDev
  • Subscriptions may renew automatically at the end of each billing period unless canceled before the renewal date, as described in the Service or billing interface.
  • Acceptable Use

    You agree that you will not use the Services to:

  • Harass, abuse, defraud, impersonate, or mislead others.
  • Upload, share, or transmit malware, viruses, hate speech, obscene material, or content that is unlawful or otherwise prohibited by applicable laws
  • Violate sanctions, export control laws, child-protection laws, or anti-money laundering and human-trafficking laws.
  • Attempt to reverse-engineer, decompile, modify, crawl, scrape, or otherwise extract data from the Services in an automated or bulk manner, except as expressly permitted by LearnNDev or applicable law
  • Interfere with or disrupt the integrity or performance of the Services (for example, by attempting unauthorized penetration testing, denial-of-service attacks, or similar activities).
  • Train or attempt to train external AI or machine learning models on LearnNDev content, data, or outputs (including large-scale scraping of course content, transcripts, or analytics) without LearnNDev’s prior written permission.
  • Violation of these rules may result in suspension or termination of your account and access to the Services. Access to the Services may be restricted in embargoed countries or to restricted persons or entities as required by export control, sanctions, or other laws.

    User Content and Intellectual Property

    “Your Content” means any data, text, images, video, audio, code, or other materials that you upload, submit, or otherwise provide through the Services (including assignments, posts, feedback, and other contributions)

  • You retain ownership of your Content.
  • By uploading or submitting Content, you grant LearnNDev a worldwide, royalty-free, non-exclusive, revocable license to host, store, display, reproduce, distribute, and process your Content solely for the purposes of operating, providing, securing, and improving the Services and as otherwise described in the Privacy Policy
  • This license ends when you remove your Content from the Services or delete your account, except where:

  • Your Content has been shared with other users and they have retained copies (for example, messages, collaborative work, or forum posts).
  • Your Content exists in backups, logs, or archives that are retained for a limited period for security, business continuity, or legal reasons. Such data will be deleted or anonymized according to LearnNDev’s retention schedules.
  • If you provide feedback, suggestions, or ideas regarding the Services, LearnNDev may use them without obligation to compensate you and without any restrictions, to the extent permitted by law

    LearnNDev Contents

    All LearnNDev content and technology (including platform design, logos, branding, trademarks, course structures, AI models, proprietary algorithms, and other materials created or provided by LearnNDev) are owned by LearnNDev or its licensors and are protected by intellectual property laws. Subject to your compliance with these Terms and any applicable Service-specific terms, LearnNDev grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable license to access and use the Services and LearnNDev content for your personal or authorized educational or organizational purposes. You may not copy, modify, distribute, sell, rent, or create derivative works from LearnNDev content except as expressly permitted by LearnNDev or applicable law.

    7. Contribution License

    [By posting your Contributions to any part of the Services, you automatically grant, and you represent and warrant that you have the right to grant, to us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right, and license to host, use, copy, reproduce, disclose, sell, resell, publish, broadcast, retitle, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt (in whole or in part), and distribute such Contributions (including, without limitation, your image and voice) for any purpose, commercial, advertising, or otherwise, and to prepare derivative works of, or incorporate into other works, such Contributions, and grant and authorize sublicenses of the foregoing. The use and distribution may occur in any media formats and through any media channels. This license will apply to any form, media, or technology now known or hereafter developed, and includes our use of your name, company name, and franchise name, as applicable, and any of the trademarks, service marks, trade names, logos, and personal and commercial images you provide. You waive all moral rights in your Contributions, and you warrant that moral rights have not otherwise been asserted in your Contributions. We do not assert any ownership over your Contributions. You retain full ownership of all of your Contributions and any intellectual property rights or other proprietary rights associated with your Contributions. We are not liable for any statements or representations in your Contributions provided by you in any area on the Services. You are solely responsible for your Contributions to the Services and you expressly agree to exonerate us from any and all responsibility and to refrain from any legal action against us regarding your Contributions. We have the right, in our sole and absolute discretion, (1) to edit, redact, or otherwise change any Contributions; (2) to re-categorize any Contributions to place them in more appropriate locations on the Services; and (3) to pre-screen or delete any Contributions at any time and for any reason, without notice. We have no obligation to monitor your Contributions.]

    Promotional Use of Non-Identifiable Content

    By uploading or using the Services, you permit LearnNDev to use non-identifiable excerpts of your activity (for example, anonymized testimonials, aggregated statistics, or blurred screenshots) for promotional, research, or educational purposes, unless you opt out by contacting LearnNDev in writing. LearnNDev will not publicly use your name, personal data, or confidential institutional content in promotional materials without your consent or unless such information is already publicly available (for example, public reviews).

    AI-Generated Content and Responsibility

    Some LearnNDev Services use AI or machine learning. AI-generated outputs may be incomplete, inaccurate, or unsuitable for certain purposes. You are responsible for:

  • Reviewing and verifying any AI-generated content before relying on it.
  • Not using AI outputs as a substitute for professional, legal, medical, financial, or other specialized advice.
  • LearnNDev is not liable for harm arising from reliance on AI-generated outputs where you fail to conduct appropriate human review or to seek qualified professional advice for decisions that carry significant risk.

    Privacy and Data Protection

    LearnNDev collects, uses, and protects personal data in accordance with its Privacy Policy, which is incorporated by reference into these Terms. Key principles include:

  • Data minimization: collecting only the personal data necessary for specified purposes
  • End-to-end encryption and secure data handling where appropriate
  • Strict access controls, logging, and employee confidentiality obligations.
  • Implementation of appropriate technical and organizational measures to comply with applicable laws, including GDPR, UK GDPR, CCPA/CPRA, DPDP Act, and similar laws, to the extent they apply
  • For Indian users, LearnNDev has appointed a Grievance Officer under the Information Technology Act 2000 and the DPDP Act 2023. The contact details are provided in the Contact / Support section below. LearnNDev will provide your personal data in a structured, commonly used, machine-readable format when technically feasible and when required by applicable law, if you request it. For details on what information is collected, how it is used, and your choices, please refer to the LearnNDev Privacy Policy.

    Security Measures

    LearnNDev implements security measures including:

  • Encryption protocols (such as AES-256 for data at rest and TLS 1.2+ or higher for data in transit, where appropriate)
  • Multi-factor authentication, role-based access controls, and least-privilege principles
  • Regular security assessments, audits, and penetration testing by LearnNDev or authorized third parties
  • Privacy-by-design, zero-trust, and defense-in-depth practices.
  • No system is 100% secure, but LearnNDev works continuously to reduce risk and address vulnerabilities. You must not attempt unauthorized security testing or penetration testing of the Services, except through LearnNDev’s authorized Responsible Disclosure Program. Security researchers may report vulnerabilities through LearnNDev’s Responsible Disclosure Program at the link provided on the LearnNDev website. Verified vulnerabilities may be eligible for recognition or rewards under LearnNDev’s bug bounty policy, as described in that program

    Data Retention and Deletion

    LearnNDev retains personal data only as long as necessary for:

  • Providing and maintaining the Services
  • Complying with legal, accounting, or reporting obligations
  • Resolving disputes and enforcing agreements
  • Examples of typical retention periods (which may vary by jurisdiction and Service):

  • Financial and billing records: up to 7 years (for tax and regulatory purposes)
  • Learning records (such as course completion data): for the duration of access plus a reasonable period (for example, up to 2 years)
  • Communication logs (such as support tickets): up to 3 years
  • Backups: typically 30–90 days
  • Actual retention periods may differ depending on legal requirements, contractual commitments with institutions, or technical constraints. Upon request, LearnNDev will delete or anonymize your personal data, except where retention is required by applicable law, for legitimate business needs (such as fraud prevention or security), or where technical safeguards require temporary retention (for example, in encrypted backups). When such reasons no longer apply, the data will be deleted or anonymized

    User Rights

    Depending on your location and applicable law, you may have some or all of the following rights:

  • Access: to know whether LearnNDev processes your personal data and to request a copy
  • Correction (rectification): to correct inaccurate or incomplete personal data
  • Deletion (erasure): to request deletion of your personal data in certain circumstances.
  • Restriction: to request restriction of processing in certain cases
  • Objection: to object to processing, including for direct marketing
  • Portability: to receive your personal data in a structured, commonly used, machine-readable format and request transmission to another controller where technically feasible.
  • Withdrawal of consent: where processing is based on consent, you can withdraw consent at any time without affecting the lawfulness of processing before withdrawal.
  • Human review: for certain automated decisions that have significant effects, you may request human review where required by law.
  • California residents may exercise “Do Not Sell or Share My Personal Information” rights via the link or contact method described in the Privacy Policy or by emailing info@learnndev.com with the subject “CCPA/CPRA Request.” Requests relating to data rights can be sent to LearnNDev’s Data Protection Officer (DPO) or designated contact at info@learnndev.com with the subject “Data Rights Request.” Additional jurisdiction-specific rights may apply, as described in the Jurisdiction-Specific Addendums

    Service Communications

    LearnNDev may send you essential service-related communications, such as security alerts, legal updates, and account or transaction notices. These are necessary for the operation and security of the Services and generally cannot be opted out of while you continue using the Services. Optional marketing or promotional communications will only be sent where permitted by law and will include a way to opt out or unsubscribe at any time.

    Termination and Suspension

    LearnNDev may suspend or terminate your access to the Services, or specific features, if:

  • You breach these Terms or any other policies referenced herein.
  • Required by law, court order, or governmental request.
  • Necessary to address security risks, fraud, abuse, or technical issues.
  • Where reasonable and legally allowed, LearnNDev will provide prior notice of suspension or termination and an opportunity to remedy the issue. You may appeal suspensions or terminations through the support channels described in the Contact / Support section. If your account or access is terminated, LearnNDev may retain certain personal data and records for purposes such as legal compliance, fraud prevention, accounting, and dispute resolution, in accordance with the Data Retention and Deletion section. You may stop using the Services at any time and may request account deactivation, subject to any contractual commitments with an institution or organization.

    Third-Party Services and Integrations

    The Services may integrate or interoperate with third-party tools or platforms (for example, payment processors, video-conferencing tools, cloud hosting providers, or third-party AI/ML services). LearnNDev does not control and is not responsible for the terms, policies, or actions of such third parties. When you use third-party services in connection with LearnNDev, your use of those services is governed by the third party’s terms and privacy policies. You should review those terms and policies before using the third-party services. If you access third-party AI/ML tools integrated with LearnNDev, you agree to comply with their usage policies in addition to these Terms. LearnNDev is not responsible for the accuracy, completeness, or outcomes of any outputs generated by third-party AI integrations. The LearnNDev Privacy Policy explains when and how personal data may be shared with third-party providers as part of delivering the Services.

    Dispute Resolution and Governing Law

    Unless otherwise required by mandatory local law, these Terms and any disputes arising out of or relating to them or the Services are governed by the laws of India, without regard to conflict-of-law principles.

    For users located in India:

  • Disputes will generally be subject to the exclusive jurisdiction of the courts located in India, unless otherwise required by law.
  • Indian users may also approach the Consumer Disputes Redressal Commissions under the Consumer Protection Act 2019 for eligible grievances
  • Users Outside India (General)

  • For users outside India, you may have the right under mandatory consumer protection laws to bring disputes in your local courts. Where such rights apply and cannot be waived, they will prevail over this clause in your jurisdiction. LearnNDev may, where appropriate, offer mediation or arbitration as alternative dispute resolution mechanisms before litigation, subject to applicable law and mutual agreement.
  • Users in the United States

    For users located in the United States, and to the extent permitted by applicable law, disputes arising out of or relating to these Terms or the Services will be resolved through binding arbitration on an individual basis rather than in court. You and LearnNDev waive the right to participate in class actions or class-wide arbitration, except where such waivers are prohibited by law. Details of the arbitration process (including rules, venue, and procedures) may be provided in a separate US-specific arbitration notice or addendum. If any part of the arbitration or class-action waiver clause is found unenforceable for a particular claim, the remaining portions will continue to apply to the fullest extent permitted by law.

    Limitation of Liability and Indemnity

    To the extent permitted by law

  • LearnNDev provides the Services with reasonable skill and care but does not guarantee that the Services will be uninterrupted, error-free, or free of harmful components
  • LearnNDev is not liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profits, revenue, data, goodwill, or business opportunities, arising from or related to your use of the Services.
  • LearnNDev’s total aggregate liability arising out of or relating to the Services or these Terms, whether in contract, tort (including negligence), or otherwise, is limited to the greater of:

  • The total fees you paid to LearnNDev for the Services in the 12 months immediately preceding the event giving rise to the claim; or
  • ₹50,000 or USD equivalent ~$600 or fees paid (whichever is greater), unless a different cap is expressly agreed in a written contract with you or your organization
  • Nothing in these Terms limits or excludes liability for:

  • Fraud or fraudulent misrepresentation
  • Gross negligence or intentional misconduct
  • Any other liability that cannot be limited or excluded under applicable law (for example, certain statutory consumer rights or liability for death or personal injury in some jurisdictions).
  • You agree to indemnify, defend, and hold harmless LearnNDev, its affiliates, officers, employees, and agents from any third-party claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your misuse of the Services
  • Your violation of these Terms or other LearnNDev policies
  • Your infringement of third-party rights, including intellectual property or privacy rights
  • For some institutional or enterprise customers, LearnNDev may agree to additional or mutual indemnity provisions in separate written agreements.

    About These Terms

    These Terms:

  • Do not create any rights for third-party beneficiaries except as expressly stated.
  • Remain enforceable even if one provision is found unenforceable; the remaining provisions will continue in full force and effect.
  • Do not waive any rights if LearnNDev fails to enforce a provision; such rights may be exercised at any time.
  • LearnNDev may update these Terms from time to time for legal, security, technical, or business reasons (for example, to reflect changes in technology, Services, or applicable laws). When changes materially affect your rights or obligations, LearnNDev will provide reasonable prior notice (for example, by email, in-app notification, or prominent notice on the website), where required by law. Continued use of the Services after changes become effective signifies acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Services. LearnNDev is committed to clear language and accessibility. Alternative formats or explanations of these Terms may be made available upon request, subject to reasonable efforts.

    Jurisdiction-Specific Addendums

    India Addendum

    For users in India, LearnNDev:

  • Complies with the DPDP Act 2023 and the Information Technology Act 2000.
  • Provides rights including access, correction, erasure, grievance redressal, and withdrawal of consent, as described in the Privacy Policy and these Terms.
  • Has appointed a Grievance Officer; details are provided in the Contact / Support section.
  • Clarifies that disputes may also be escalated to Consumer Commissions under the Consumer Protection Act 2019, where applicable.
  • EU Addendum (GDPR)

    For users in the European Union:

  • GDPR rights apply, including rights to erasure, objection, restriction, portability, and the right to lodge a complaint with your local Data Protection Authority.
  • LearnNDev generally acts as a Data Controller for personal data it collects directly and as a Data Processor when processing personal data on behalf of institutional customers, as defined in GDPR. The exact role may depend on the specific service and contract.
  • UK Addendum (UK GDPR)

  • Equivalent rights under UK GDPR and related UK data protection laws remain protected, including the right to complain to the Information Commissioner’s Office (ICO).
  • California Addendum (CCPA/CPRA)

  • Additional rights apply under CCPA/CPRA, including the right to know, delete, and correct personal information, and the right to opt out of the “sale” or “sharing” of personal information as defined by California law.
  • You can exercise these rights via the “Do Not Sell or Share My Personal Information” mechanism or by contacting info as described in the Privacy Policy.
  • Other Regions

    For users in other jurisdictions, LearnNDev will comply with applicable local privacy, consumer protection, and data laws. If mandatory local law grants you rights that conflict with these Terms, those rights will prevail in your jurisdiction
